Civil & Domestic Standby Service

This page explains the role of the Pennsylvania State Constable’s Office, Nazareth – Lehigh Valley, in providing Civil Standby, Domestic Standby, Custody Exchange, and Property Retrevial Services.

Introduction & Purpose

The Pennsylvania State Constable’s Office, Nazareth – Lehigh Valley, provides authorized, impartial safety, security, and peacekeeping support when court-ordered actions or volatile civil matters require the presence of a sworn peace officer to prevent a breach of peace or violation of court order. These services, known as Civil Standbys, ensure the lawful, safe, and orderly execution of specific civil and domestic events. Our Constables act strictly to maintain the peace and document events; they do not mediate, provide legal advice, or determine rights.

Civil Standby Services Provided by This Office

Child/Dependent Custody Exchange Standbys

This highly sensitive service involves providing a neutral, secure, and documented presence during court-ordered custody exchanges. The Constable's role is to ensure the handover is conducted peacefully, preventing disputes, threats, or breaches of a standing custody order.

Civil Matters & Property Standbys

We provide service during the execution of certain civil orders, such as Right-of-Way, Property Recovery, and Property Access enforcement, where prior disputes or known conflict poses a risk. This presence ensures that legal access or action occurs without physical interference or criminal activity.

Special Enforcement Standbys

This covers any unique civil enforcement matter where the court has directed a peace officer to be present, to prevent violence or threats during the service or execution of papers or court orders, such as retrieving personal property following an eviction, divorce decree, or similar.

Standby services are initiated by the parties involved or their legal counsel. While rapid response is available, advanced scheduling is highly recommended.

  • 2. Authorization and Scope: Requests must include the necessary court documents/orders (e.g., Custody Order, PFA, or Writ) that establish the legal basis for the standby.

  • 3. Non-Mediation Policy: The requesting party must understand that a peace officer will not intervene in disputes over property ownership, custody terms, or legal interpretations. We will follow the court order, and document the situation as necessary. Intervention is limited strictly to preventing a breach of the peace or a criminal act, or making an arrest.

  • 4. Cost of Services: All standbys are provided on a contractual basis, and are subject to payment requirements as detailed by the Fee Sheet of this Office. Due to the high-priority nature of these services, advance scheduling is highly recommended to ensure availability.
